Acceptable Use Policy

This Acceptable Use Policy applies to everyone who uses Aalto. It is incorporated into the Aalto Services Agreement (for businesses) and the Consumer Terms of Service (for drivers and other individuals).

Overview

Section 1 (Use of the Consumer Services) applies to your use of the Consumer Services (the Aalto iOS and Android apps and the Aalto web application) under the Consumer Terms of Service. Section 2 (Prohibited and Restricted Businesses) applies to businesses using Aalto services under the Aalto Services Agreement, and is the list referenced by the “Prohibited or Restricted Business”, “High-Risk Jurisdiction”, and “High-Risk Person” definitions in the General Terms. Capitalized terms not defined here have the meanings given to them in the agreement that applies to you.

1. Use of the Consumer Services

The Consumer Services are only for your own personal, non-commercial use. If you want to use Aalto for a business (for example, to operate charging stations or manage a fleet), Aalto offers business products under the Aalto Services Agreement. You must not, and must not allow others to:

  • Breach the Consumer Terms of Service or any other agreement between you and us;
  • Violate any law, statute, ordinance or regulation (for example, those governing financial services, consumer protection, unfair competition, anti-discrimination or false advertising);
  • Infringe our or any third party’s Intellectual Property Rights;
  • Create or control more than one personal account for yourself without our express authorization, through, among other methods, using a name that is not yours, using a temporary email address or phone number, or providing any other falsified personal information;
  • Provide false, inaccurate or misleading information;
  • Refuse to cooperate in an investigation or provide confirmation of your identity or any information you provide to us;
  • Attempt to double dip during the course of a dispute by receiving or attempting to receive money from both us and a Station Operator, bank or card issuer for the same charging session or transaction;
  • Use the Consumer Services in a manner that results in or may result in complaints; disputes, claims, reversals or chargebacks; or fees, fines, penalties or other liability or losses to Aalto, Station Operators, other customers, third parties or you;
  • Use the Consumer Services in a manner that we, Visa, Mastercard, American Express, Discover or any other payment network reasonably believes to be an abuse of the card system or a violation of card association or network rules;
  • Have any amounts owed to us that you fail to pay;
  • Use the Consumer Services to test payment card behaviors, or make excessive or unexplainable transactions;
  • Start a charging session for a vehicle or with equipment you are not authorized to use, or tamper with, damage, or circumvent (or attempt to circumvent) payment at any charging equipment;
  • Use the Consumer Services to charge any vehicle other than a standard, unmodified, industry-manufactured electric vehicle, including any home-built or kit vehicle or any vehicle with a home-built or personally modified onboard charger or charging equipment;
  • Resell energy, charging access, or any other product obtained through the Consumer Services;
  • Take any action that imposes an unreasonable or disproportionately large load on our websites, software, or systems (including any networks and servers used to provide any of the Aalto services) operated by us or on our behalf;
  • Facilitate any viruses, trojan horses, malware, worms or other computer programming routines that attempt to or may damage, disrupt, corrupt, misuse, detrimentally interfere with, surreptitiously intercept or expropriate, or gain unauthorized access to any system, data, information or Aalto services;
  • Use an anonymizing proxy; use any robot, spider, other automatic device, or manual process to monitor, scrape, or copy our websites or the Consumer Services (including station locations, availability, and pricing data) without our prior written permission (this does not restrict general-purpose search engines indexing publicly available pages in accordance with our robots-exclusion directives); use any device, software or routine to bypass our robot exclusion headers; or frame, mirror, or embed any part of our websites or the Consumer Services;
  • Interfere or disrupt or attempt to interfere with or disrupt our websites, software, systems (including any networks and servers used to provide any of the Consumer Services) operated by us or on our behalf, any of the Consumer Services, or other users’ use of any of the Consumer Services;
  • Take any action that may cause us to lose any of the services from our Internet service providers, payment processors, charging network partners, or other suppliers or service providers;
  • Harass and/or threaten our employees, agents, or other users;
  • Use the Consumer Services in a way that violates prohibitions relevant sanctions authorities impose;
  • Create content, products, or services using any part of the Consumer Services (including data obtained from them);
  • Use or reproduce any part of the Consumer Services (including any trademarks presented in the Consumer Services), except as law expressly allows;
  • Work around any of the technical limitations of the Consumer Services, or enable functionality that is disabled or prohibited;
  • Decompile, extract source code from, or reverse engineer the Consumer Services; or
  • Transfer or move software, technology, or services (including our software or encryption software) to or from any country in a way that law does not permit.

User Content and Community Guidelines

The Consumer Services let you contribute content about charging stations, including reviews, ratings, photos, suggested edits, and other information (“User Content”). We want this content to help other drivers, so we ask everyone to keep it honest, relevant, and respectful. You are solely responsible for the User Content you submit, and it must reflect your own genuine experience.

By submitting User Content, you agree to these guidelines and to the agreement that applies to you (the Consumer Terms of Service or the Aalto Services Agreement). You must not submit User Content that:

  • Is objectionable, obscene, pornographic, or sexually explicit;
  • Is hateful, discriminatory, or promotes violence or harm against any individual or group (including on the basis of race, ethnicity, national origin, religion, disability, gender, age, or sexual orientation);
  • Harasses, bullies, defames, threatens, or intimidates any person, or is intended to demean or abuse another user or contributor;
  • Is illegal, or promotes or facilitates illegal activity;
  • Infringes any third party’s intellectual property, privacy, publicity, or other rights (only submit photos you took and content you have the right to share);
  • Contains personal or confidential information about another person (such as a name, address, phone number, license plate, or face) without their consent;
  • Is false, deceptive, or misleading, including fake reviews, reviews you were paid to write, or ratings that do not reflect a genuine experience;
  • Is spam, advertising, or off-topic, or is unrelated to the charging station or the driving/charging experience; or
  • Contains malware, or attempts to interfere with or gain unauthorized access to the Consumer Services or other users.

Zero tolerance for abuse. We do not tolerate objectionable content or abusive users. The Consumer Services provide a way to report content you believe violates these guidelines, and to block a user so you no longer see their content. We review reports and, where content or behavior violates these guidelines, we may remove the content, and we may warn, suspend, or terminate the account of the contributor, including permanently for serious or repeated violations, with or without notice. We aim to act on reports of objectionable content promptly.

Our rights. We are not obligated to monitor User Content, but we may review, moderate, refuse, edit, or remove any User Content at our discretion. Reviews and photos may be published only after moderation. Removing content does not waive our right to enforce these guidelines. You retain ownership of your User Content, but you grant Aalto a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, modify (for example, to resize an image), publish, publicly display, and distribute your User Content in connection with operating, providing, and promoting the Consumer Services. This license continues even if you stop using the Consumer Services, for content that others have interacted with or that we have retained as permitted by our Privacy Policy.

2. Prohibited and Restricted Businesses

This Section 2 applies to businesses using Aalto services under the Aalto Services Agreement. Business Users must not use the Aalto services to conduct, transact with, or enable any of the following, unless Aalto has pre-approved the activity in writing:

  • Any activity that is illegal in the jurisdictions where the Business User operates or where its customers are located;
  • Any business or activity involving fraud, deception, or unfair, abusive, or predatory practices, including the sale of energy or charging services that are deliberately mispriced, mis-metered, or misrepresented;
  • Money laundering, terrorist financing, or any transaction designed to disguise the origin of funds, including using charging or energy transactions to move funds unrelated to the bona fide sale of energy or related services;
  • Any business or individual that is the target of sanctions, or any activity in or involving a High-Risk Jurisdiction. “High-Risk Jurisdictions” are jurisdictions subject to comprehensive sanctions or that Aalto otherwise deems to be of particularly high risk, currently: Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. “High-Risk Persons” are individuals or entities Aalto deems to be of particularly high risk, including persons on applicable sanctions lists (such as the lists identified by the U.S. Office of Foreign Assets Control) and entities owned or controlled by them;
  • Any business or activity prohibited or restricted by Aalto’s Financial Providers, including the businesses identified in our payment processor’s prohibited and restricted businesses list, which applies to payments made through the Aalto services;
  • Selling energy or charging services using equipment, metering, or practices that do not comply with applicable safety, metering, or measurement law.

Aalto may update this list at any time as our risk, legal, and Financial Provider requirements evolve. If you are unsure whether your business or a planned use is permitted, contact us at legal@aalto.energy before proceeding.

Enforcement

We may investigate any suspected violation of this policy, and may ask you for information in connection with an investigation; you must cooperate with reasonable requests. If we believe you have violated this policy, we may take any action we consider appropriate, including warning you, removing content or stations, withholding or reversing payments as the applicable agreement allows, limiting, suspending, or terminating your account or access to the Aalto services, and reporting activity to law enforcement, regulators, card networks, or other relevant parties. We are not obligated to provide advance notice before taking enforcement action, although we will do so where commercially reasonable and permitted by law.
